This week, Randi, Jaime, and Gabe discuss the plan to fight back. After an abysmal 2016 election, pro-choice Ohioans are not giving up. On November 16th, they literally surrounded the Ohio Statehouse in protest, forming a line of 400 protesters along Broad street, High Street, State Street, and 3rd Avenue.
The protest was in anticipation of some version of anti-abortion legislation in the remaining days of 2016. The legislature has only a few remaining scheduled session days left, and two bills have been rumored to be likely to get additional attention:
Senate Bill 127 — A 20-week abortion ban
In September, Ohio Right to Life indicated to the Cleveland Plain Dealer that they intended to try to pass a 20-week abortion ban during the lame duck session. There were 20,976 abortions performed in Ohio in 2015, but only 2% of all abortions reported were at 20 weeks are later. Anecdotal evidence shows that most of these procedures are performed after women receive diagnoses of medical complications, either threatening their own health or their pregnancy. Bans on abortions after 20-weeks punish women who wanted to have healthy pregnancies. Because 20-week bans block abortion before a point of viability, they are unconstitutional according to guidelines established in Planned Parenthood v. Casey.
Senate Bill 254 — Restrictions on abortion providers
A new bill calls for abortion providers to exclusively use cremation or internment procedures, which does not improve the quality of care for women. Additionally, nothing in current Ohio law prohibits providers from offering these services to patients. If women are interested in these options, they can already inquire with their doctor. Imposing new regulations on providers increases costs without benefit, creating an undue burden which may violate new constitutional standards established by Whole Woman’s Health v. Hellerstedt.
